These Terms and Conditions govern the use of products and services provided by Aviva Smart Solutions Pvt Ltd, a company engaged in the manufacturing and supply of UPS systems, solar panels, and related equipment for household and industrial purposes. By purchasing or using our products or services, You agree to be bound by these Terms and Conditions.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. These definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

Company refers to Aviva Smart Solutions Pvt Ltd, having its registered office at No 5, Survey No 45, Vishwadeepam Post, Rajivgandhi Nagar, Chandana Layout, Sunkadakatte, Bengaluru, Karnataka 560091.

Products refer to UPS systems, solar panels, and all related equipment supplied by the Company.

You refers to the individual or legal entity purchasing or using the Company’s Products or services.

Use of Products

All Products supplied by the Company are intended for use as per the instructions provided in the user manual or documentation. Any misuse, improper installation, negligence, or unauthorized modification of the Product shall result in the immediate voiding of warranty and the Company shall not be held liable for any damages arising from such actions.

Orders and Payments

All orders placed with the Company are subject to acceptance. The Company reserves the right to accept or reject any order at its sole discretion. Prices of Products are subject to change without prior notice. Orders will be processed only upon receipt of full payment or as per agreed payment terms.

Cancellation Policy

Cancellation of orders is permitted only if the Product has not yet been delivered. Once the Product has been delivered to the Customer, no cancellation requests shall be accepted under any circumstances.

Delivery and Transportation

The Company shall make reasonable efforts to deliver Products within the estimated delivery timeline. However, delays may occur due to unforeseen circumstances beyond the Company’s control. In case of any damage caused to the Product during transportation, the Company shall provide a replacement after proper verification of the issue, provided the damage is reported within the specified timeframe.

Returns and Exchange

The Company follows a strict no-exchange policy. Returns are accepted only in cases where the Product is damaged during transit or has a verified manufacturing defect. No returns shall be accepted for reasons such as change of mind or improper usage.

Refund Policy

Refunds shall only be processed if an order is cancelled prior to dispatch or if the Product is unavailable. Once the Product has been delivered and accepted by the Customer, no refunds shall be issued. In case of approved refunds, the amount shall be processed within a reasonable timeframe through the original mode of payment.

Limitation of Liability

To the maximum extent permitted by applicable law, Aviva Smart Solutions Pvt Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Products.

Warranty

All Products are covered under a limited warranty as specified in the product documentation. The warranty covers manufacturing defects under normal usage conditions and does not cover damages caused by misuse, improper installation, or external factors.

Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of India. Any disputes arising shall be subject to the jurisdiction of courts located in Bengaluru, Karnataka.

Policy Acceptance

By purchasing or using the Company’s Products or services, You acknowledge that You have read, understood, and agreed to be bound by these Terms and Conditions, along with all other applicable policies including Shipping, Return, Refund, and Warranty policies.
